This Acceptable Use Policy (the “Policy”) governs the acceptable use of Nfinity Networks services (the “Service”). By using the Service, you acknowledge that you and any users accessing the Service through your account (“Users”) are bound by this Policy. You are responsible for ensuring that Users comply with this Policy, and any violations of this Policy by Users accessing the Service through your account are your responsibility. While we do not aim to control or monitor online experiences or content, we reserve the right to edit or remove content that violates this Policy or is otherwise unlawful, harmful, or offensive. This Policy applies to all aspects of the Service provided by Nfinity Networks.
Nfinity Networks reserves the right to modify this Policy at any time without notice. We will endeavour to notify customers of any modifications via email or by posting a revised version of the Policy on our website.
Rights of Nfinity Networks
Suspension or Termination of Service
If Users engage in conduct while using the Service that violates this Policy or is otherwise illegal or improper, Nfinity Networks reserves the right to suspend and/or terminate the Service or the User’s access to the Service. While we will generally attempt to notify you of any activity in violation of this Policy and request that the User cease such activity, we reserve the right to suspend or terminate the Service or a User’s access to the Service without notification in cases where the operation of the Nfinity Networks infrastructure is threatened or in cases involving unsolicited commercial email/SPAM, mail relaying, alteration of source IP address information, denial of service attacks, illegal activities, harassment, or copyright infringement. We may also take any other appropriate action against a User for violations of this Policy.
Cooperation with Investigations
Nfinity Networks will cooperate with appropriate law enforcement agencies and other parties involved in investigating claims of illegal or inappropriate activity. We reserve the right to disclose customer information to the extent authorized by federal or provincial law.
Filters
Nfinity Networks reserves the right to install and use, or to have you install and use, any appropriate devices to prevent violations of this Policy, including devices designed to filter or terminate access to the Service.
Prohibited Uses/Actions
Upon the detection of complaints (abuse) regarding the services leased by the Customer, Nfinity Networks allows a designated time frame for resolution.
Nfinity Networks reserves the right to immediately block the ports, outgoing traffic, or IP address associated with the service without prior notice to the Customer.
Upon blocking, the Customer will receive a notification of the complaint via their authorized email address. The Customer agrees to respond within the specified time period indicated in the notification. During this time, the Customer is responsible for independently addressing the reasons for the complaint and implementing measures to prevent future abuses. Additionally, the Customer undertakes to inform Nfinity Networks of the actions taken.
If the Customer receives three (3) or more similar abuses within one month for any of the services ordered, access to the services may be completely blocked, and/or the data stored on the account may be deleted without the possibility of recovery, with or without additional notice. Exceptions include abuses (complaints) related to spam, where the service may be blocked after the second complaint of the same nature, and abuses (complaints) related to Botnet Controller activities, where the service is instantly blocked without the possibility of recovery.
Below is the list of possible complaints (abuses) and corresponding actions from Nfinity Networks’ technical support:
Illegal Activity
The Service shall not be used for any unlawful activities or in connection with any criminal or civil violation. Use of the Service for transmission, distribution, retrieval, or storage of any information, data, or other material in violation of any applicable law or regulation is prohibited. This includes, without limitation, the use or transmission of any data or material protected by copyright, trademark, trade secret, patent, or other intellectual property right without proper authorization, and the transmission of any material that constitutes an illegal threat, violates export control laws, or is obscene, defamatory, or otherwise unlawful. Customers have 12 hours to respond to complaints regarding illegal activity.
Unauthorized Access/Interference
Users may not attempt to gain unauthorized access to any portion of the Nfinity Networks infrastructure or interfere with its normal functioning, operation, or security. Users may not use the Service to engage in any activities that may interfere with the ability of others to access or use the Service or the Internet. Customers have 12 hours to respond to complaints regarding unauthorized access or interference.
Unsolicited Commercial Email/Spamming/Mail Bombing
Users may not use the Service to transmit unsolicited commercial email messages or deliberately send excessively large attachments to one recipient. Spamming or mail bombing is prohibited. Use of the Service to collect responses from mass unsolicited email messages is also prohibited. Customers have 12 hours to respond to complaints regarding unsolicited commercial email, spamming, or mail bombing.
Spoofing/Fraud
Users are prohibited from intentionally or negligently injecting false data into the Internet. Users may not attempt to send email messages or transmit any electronic communications using a name or address of someone other than themselves for purposes of deception. Customers have 12 hours to respond to complaints regarding spoofing or fraud.
Usenet Postings
All postings to Usenet groups must comply with the group’s charter and other policies. Users are prohibited from cross-posting to unrelated news groups or posting off-topic messages. Disrupting newsgroups with materials that are frivolous, unlawful, obscene, threatening, abusive, libellous, or hateful is prohibited. Customers have 12 hours to respond to complaints regarding Usenet postings.
Wireless Equipment
Users may not install cellular or wireless equipment/antennae on the Nfinity Networks premises without prior written permission. Customers have 12 hours to respond to complaints regarding unauthorized installation of wireless equipment.
Complaints
Nfinity Networks receives complaints regarding violations of this Policy. Users are responsible for promptly investigating and remedying any violations of this Policy. Nfinity Networks may inform complainants of ongoing investigations and provide necessary information to facilitate resolution.
Responsibilities of Customers
Users are responsible for maintaining the confidentiality of password and account information and ensuring the security of their network. Users must immediately notify Nfinity Networks of any unauthorized use of their account or any other security breach.
Impending Security Event Notification
Users must notify Nfinity Networks immediately of impending events that may negatively affect the Nfinity Networks infrastructure, including security threats.
Configuration
Users are responsible for configuring their systems to provide maximum accountability and security. Users must educate themselves on basic security measures and promptly report any system violations.
Privacy
Nfinity Networks makes no guarantee regarding the security and integrity of data transmitted via the Service or over the Internet.
Additional Terms and Conditions
The use of the Nfinity Networks Service is subject to the terms and conditions of any agreements entered into by the customer and Nfinity Networks.

Complaints regarding violations of this Policy should be sent to Nfinity Networks. Please include all relevant information to facilitate investigation.
Live attacks from Nfinity Networks customers should be reported to Nfinity Networks immediately.
